ORDER ON THE RECTIFICATION APPLICATION FILED BY THE APPLICANT – ORIGINAL COMPLAINANT DATED 11-03-2026 (Order Pronounced on Monday, October 2026) (Rectification Application Reserved for Orders on 03-06-2026) (Hearing Through Hybrid Mode) 1. The applicant (original complainant) had filed the aforesaid complaint seeking directions from the MahaRERA, to the respondent, to hand over possession of the flat and to pay interest for delayed possession, as prescribed under Section 18 of the Real Estate (Regulation and Development) Act, 2016 (hereinafter referred to as “RERA”). The aforesaid complaint was heard and disposed of by the MahaRERA vide a final common order dated 23-02-2026, passed in a total of 21 complaints (hereinafter referred to as the said impugned order). 2. However, the applicant (original complainant) has filed an online rectification application before the MahaRERA on 11-03-2026, mainly seeking the following rectifications in the said order dated 23-02-2026 passed by MahaRERA:– i) In the table at para-no. 5, in respect of the complaint at Sr. No. 3 (Complaint No. CC12501765), the date of possession is mentioned as 31-12-2024, which is required to be corrected as 31-12-2023 as per Clause 9 of the Agreement for Sale dated 22-10-2019. ii) Because of the above errors, the date from which interest is applicable becomes 31-12-2025 Page 1 of 3 Rectification Application No. CC12501765/APPL/RT/1 (including a grace period of 12 months), which is required to be changed to 31-12-2024. 3. The present rectification application was heard by the MahaRERA on 03-06-2026 as per the Circular No. 49 dated 12-09-2025 issued by MahaRERA for hearing of complaints through Hybrid Mode. Both the parties have been issued prior intimation of the said hearing. Accordingly, both parties appeared and made their submissions. The MahaRERA has perused the available record. 4. After hearing the arguments of both parties, the following Roznama was recorded in this rectification application - Both the parties are present. The applicant - allottee (original complainant) has filed this rectification application on 11-03-2026 with respect to the order of Authority dated 23-02-2026. Prima facie the date of possession mentioned in the agreement for sale is 31-12-2023 and not 31-12-2024. Therefore, consequently, the applicant claims that the interest should be payable from 01-01-2025 and not from 01- 01-2026, considering the moratorium for Covid-19 pandemic. Although the said fact needs to be verified from the records, prima facie, it seems that there is a typographical error that has occurred while issuing the said order . 5. In the present case, during the course of hearing, both parties have submitted that the agreed date of possession is 31-12-2023. However, there is an error apparent on the face of the record. 6. In this regard MahaRERA is of the considered view that the provisions of Section 39 of RERA empower MahaRERA to rectify a mistake apparent on the face of the record, without amending the substantive part of the order. In the present case, it appears that this application is filed for seeking correction in the incorrect fact about the date of possession and its consequential calculation. It does not seek reconsideration of the relief already granted by MahaRERA in favour of the applicants vide the said impugned order dated 23- 02-2026. 7. In view of the above, considering the actual agreed dated of possession i.e., 31-12-2023 and calculating the 12 months grace period on account of the Covid-19 pandemic already granted in para- no. 22 of the said impugned order in respect of the applicant, the extended date of possession comes to 31-12-2024, which is wrongly mentioned as 30-12-2025 in the table at para no. 26 of the said order. Accordingly, interest for delayed possession shall commence from 01-01-2025. The correction is confined to the complaint filed by the applicant ( Sr. No. 3 in the said impugned order). 8. In view of the above, the following order is passed:- a) The rectification application is hereby allowed. Page 2 of 3 Rectification Application No. CC12501765/APPL/RT/1 9. b) In the tables at para- nos. 5 and 26 of the said impugned order dated 23-02-2026, the agreed possession date against Sr. No. 3, (Complaint No. CC12501765), shall be read as 31-12-2023. c) Accordingly, in the column (D) of the table at para- no. 26, the extended possession date for the said complaint shall be read as 31-12-2024 instead of 30-12-2025. d) Consequently, interest under paragraph 32(d) of the said impugned order shall be calculated from 01-01-2025, subject to the remaining terms and directions of the said impugned order. e) Rest of the order be read as it is. 10. With these directions, the rectification application stands disposed of.
