                                             ORDER
                                     (   21't August 2026)

         1.    This matter is referred to be under non-compliance of the final order, dated
                18.03.2026 passed by the Hon'ble Chairperson, MahaRERA, whereby the
               complainant is entitled to claim interest for delay in handover of
               possession of the flat on the total amount paid to the respondent
               (excluding amounts paid towards stamp duty, registration and such other
               amount paid to the statutory authorities) from the date as mentioned in
               table at para 12 the actual date of handover of possession with O.C.
               Further the total arrears of interest accrued shall be set off / adjusted
               against the outstanding dues required to be paid by the complainant, if
               any and the remaining amount shall be paid by respondent in one
               instalment to the complainant, within 60 days from the date of the said
               order.

               The complainant in person submitted that the respondent has not paid
               arrears of interest accrued as mentioned therein the final order within 60
               days and therefore, the respondent has committed non-compliance of the
               final order. It is prayed for issuance of recovery warrant against the
                respondent.

  3.       The respondent failed to appear and absent, hence no submission on their
           behalf.

  4,       Perused the final order. Admittedly, the respondents has not paid arrears

           of interest accrued, as mentioned therein clause (b) and (c) of para 16 of
           the final order within 60 days. It is therefore, the respondent has
           committed non compliance and violation of the directions in the final order.
           Hence, I pass following order;

                                            ORDER

        (a) Issue recovery warrant against the respondents for recovery of accrued
           interest amount as mentioned therein the final order, addressing the
           concerned District Collector to execute the same for recovery of the
           amount in accordance with law vide Section 40(1) of the RERA.
        (b) In view of the above, the present application stands disRosedjff.
