                               INTERIM ORDER

   The complainants have filed this complaint seeking directions from
   MahaRERA, to the respondents to hand over the possession of the flat to
   the complainants and to pay the amount paid by them along with interest
   under Section-r8 of the Real Estate (Regulation and Development) Act, 2ot 6
   (hereinafter referred to as "RERA") with respect of booking of their flat
   bearing no. 405 on the 4th floor in the respondent's project known as
   "Mateshwari Altura", bearing MahaRERA proiect registration No.
   P517oooio188, situated at Thane.

2. This matter was heard on 18tl' November 2o19. During the hearing, the
   complainants brought to the notice of MahaRERA that they had purchased
   their respective flats in the respondents' proiect vide a registered agreement
   for sale dated oglttltot4. The respondents were liable to hand over the
   possession of their flat on or before December 2oi6 but the respondents
   failed to do so. Hence, they were now seeking refund of the amounts paid
   by them. Also, they have addressed the complaint to be h€ard before the
   Adjudicating Officer, MahaRERA. The respondent also concurred with the
   prayer for adjudication.

3. ln the light of the above, since complainants are seeking refund as well as
   compensation, and since they have addressed the complaint to the
   Adjudicating Officer, the complaint filed by the complainants is transferred
   to the Adjudicating Officer, Mumbaito take appropriate action as per the sec
   r8 of the RERA and rules made thereunder.
