                                                 ORDER

           1.     Vide order, dated 02.02.2023 passed by
                                                                   Hon,ble lvlember_I, MahaRERA,
                 14   umbai, com plaint stands disposed off as the
                                                                   matter amicably             setued
                 between the parties as per the terms of
                                                              conciljation.

       2.        Heard complainant, who submits in spite of
                                                                  consent terms, neither
                 possession nor interest given by the
                                                      respondent and respondent has not
                 appried the order and prayed for suitabre
                                                             action. complainant further
                 submits that copy of the Roznama along with
                                                             consent terms is furnished on
                 record on the other than, respondent absent and
                                                                  hence submission of            the
                 respondent not on record.


      3.        Copy of the consent terms on record reflecting
                                                                  that respondent is wjlling to
                 offer possession on or before 31.t March,2023 to
                                                                       the complainant along
                 with the delayed interest possession @ 9% from
                                                                   the date of payment ti the
                date of possession. Thus in the light of aforesaid position
                                                                             on record, this is
                just, proper and suitable case for issuance
                                                            of recovery warrant for Tec overy
                of dues from the respondent,


      4.        Accordingly, issue recovery warrant for recovery
                                                                                 of dues from the
                respondent-promoter till delivery of possession of the
                                                                        booked premjses to
                the complainant as per the consent terms dated 2A.LO,2OZ2
                                                                             and as per the
y--             order, dated 02,02,2023, addressing to the District
                                                                    collector concerned, on
       rurnishlng appropriate and comprete papers
                                                    by the comprainant within two
       months from the date of this order and in case
                                                            of failure to comply the
       same/ this Non-comp iance Apprication automaticaly
                                                              stands dismissed and
       disposed off.
