10. AND WHEREAS the title of the said property Is clear, marketable and

    Nashik on 10/08/2018 & on 27/03/2019.
11. AND WHEREAS, the Promoters have at the request of the Allottees

13. The Allottees have understood the area calculation of the said flat i.e.
    net carpet area as per sanctioned building plan from the Promoters.
    The Allottees after understanding the area calculation of the said flat
    have decided to purchase the said flat from the Promoters -.It Is hereby
    specifically agreed between the parties to this Agreement that the

       18. AND WHEREAS            the Promoters have' entered into a standard

            Ailottee(s) of the Apartments & to receive the sale conslderation in
            respect thereof;
       22. ' AND WHEREAS on demand from the Allottee, the Promoters have
            given Inspection to the Allottee of all the documents of title relating to
            the project land and the plans, designs and specltlcations prepared by
            the Promoter's Architects Shri. Saurabh Ravi Amrutkar & Structural
            Engineer Shri. Ravi Arnrutkar of Nashlk and of such other documents as

    2016 (hereinafter referred to as "The Said Act") and the Ryles and
    Regulations made there under;
23. AND WHEREAS the authenticated copies of certificate of title Issued
    by the Advocate of the Promoters, authenticated copies of property
    card or extract of village forms VI and VII and XII or any other relevant
    revenue record showing the nature of the title of the Promoters to the
    project land on which the Apartment Is to be constructed or are to be
    constructed have been annexed hereto and marked as Annexure 'A' &.
    'B' respectively.
24. AN D WHEREAS the authenticated copies of the plans of the .layout as
    approved by the concerned local authority have been annexed hereto
    and marked as Annexure C-1.
25. AND WHEREAS the authenticated copies of the plans' of ilie
    arnelqamanon plan as proposed by me Promoters and according to
    which ~heconstructionof the building and open spaces are proposed to
     be provided for on the said project have been annexed hereto and
     marked as Annexure C-2.
26. AND WHEREAS the authenticated copies of the plans and
     specifications of the Apartment agreedto be purchased by the Allottee,
     as sanctioned and approved by the local Authority have been annexed
     and marked as Annexure 'D'.
27. AND WHEREAS the Promoters have got some of. the aJ'lprovalS
                                                              . from
     the concerned local authority(s) to the plans, the specifications;
     elevations, sections and of the said building and shall obtain the
     balance approvals from various authorities from time to time so as to
     obtain bullding completion certificate or occupancy certificate of the
     said building.
.28. AND WHEREAS while sanctioning the said plans concerned local
     authority and/or Government has laid down
                                           ,   certain terms, conditions,
     stipulations and restrictions which are to :beobserved and performed by
     the Promoters while developing the project land and Iile said building
     and upon due observance and performance of .whlch only. the
     completion or occupancy certificate In respect·of the said building shall
     be granted by the concerned local authority.
29. AND WHEREAS the Promoters have not used & utilized total F.S.I.
     area available for construction of building on the project land. The

     the terms, conditions and stipulations contained in this Agreement and

     d)     The total price Is. escalation-free, save and except escalations/
            increases, due to increase on account of development charges
            payable to the competent authority and/or any other Increase In
            charges which may be levted or Imposed by the competent a"thority
            local       bodies/Government from. time            to time, The Promoters
            undertakes and agrees that while raising 'a demand on the Allottee for
            Increase in development charges, cost or levies' imposed by the
            competent authorities. etc. the Promoters shall enclose the said
            nQtlflcation/Qrder/rules/regulation published/issued in that behalf to
            that effect along with the demand letter being Issued.to the Allottee,
           . which shall only be .appucaoleon subsequent payments.
     e)     The Promoters shall confirm the final carpet area that has been
            .allotted to the Allottee afte~ the construction of ·the Building is
            complete and the occupancy certificate is granted by the competent
             authority, by furnishing details or the changes, if any, in the carpet
             area, subject to a variation 'cap of three percent. The total price
            .payable for the carpet area shall be recalculated upon confirmation by
            . the Promoters. If there is any reduction In the carpet area within the
             defined limit then Promoters' shall refund the excess money paId by
           '. Allottee Within forty-five days with annual Interest at the rate
             specified. in the Rules, from the date when s~ch an excess amount
             was paid by' the Allottee. If there Is any Increase in the carpet area
             allotted to Allottee! .ttle Promoters. shall dem~nd additional amount
             from the Allottee as per the' next milestone of the payment plan. All
             these monetary adjust~ents. shall be. made at the same rate per
             square meter as agreed·lnCiause·l(.a) of thiS.Agreement.
      f)     The Allottee authorizes the Promoters to adjust/appropriate aU
             payments·made by him/her under any head(s) of dues against lawful
              ol:.ltstanding, If an.y, IIi his/her name as the Promoters may in its sole
              discretion deem .flt and the Allottee undertakes not to objeet/
              demand/difect; the Promoters to adjust his payments in any manner.
     2)     The Promoters hereby agrees 'to observe, perform and comply with all
            the terms, conditions, stipulations and re;s_trlctionsjf any, which may
            have been imposed' by the concerned local authority at the time of
            sanction'lng the said plans or.thereafter and shall, before handing over
            'possesslofl of the Apartment to the Allottee, ~taln from the concerned
             local authority occupancy and/or completion certificate In respect of the
             Apartmertt. .
            TIme Is essence for the Promoters as well as the Allottee. The
             Promoters shall abide by the time schedule for completing the project
             and handing. over the AP9rtment

4) . If the Promoters fails to abide by the time schedule for completing the
      project and handing over the Apartment to the Allottee, the Promoters
      agrees to pay to the Allottee, who does riot Intend to withdraw from
      the project, interests as specified in the Rule, on all the amounts paid
      by the Allottee, for evert month of delay, till the handing over of the
      possession. The Allottee .agrees to pay to me 'Promoters, interest as
      specified in the Rule, on all the delayed paymen~.which· become due
      and payable by the Allottee to ,the Promoters under the terms of this
      Agreement from the date the said amoun~Is payable by the Allottee(s)

  a) .Wlthout prejudIce to the right of Promoters to charge 'interest in
      terms .of clause No.2 mentioned above, 'on the Allottee committlng
      default in payment on due date of any amount due and payable by
    . the Allottee to the Promoters under this Agreement (Including his/her
    , proportionate share of taxes levied by concerned 'Iocal authgrlty and
      other outgoings) and. on the Allottee committing three defaults of
      payment of lnstallments, the Promoters shall at their own option, may
      terminate this Agreement.
  b) Provided that, Promoters shall give notice of 15 days In writing to the
