Narayanrao Kotgire R/o.: Frat No'2, Priyanka Apartment, Khinvasara park, Urka Nagari, Aurangabad, partner of M/s. Everest Reartors, approached me and requested issue Title cum Search Report, to in respect of the land Gut No.52/2, totaty admeasuring 11 H 4L R to the extent of 1 H 76.25 R rand situated at viilage wadgaon Korhati, Tq,& Dist. Aurangabad, I have gone through the Documents of tite produced by him before me and also took the search at the office of sub-Registrar, Aurangabad, in respect of the above property for last 13 years and thereupon I am issuing this tifle sum search report as under.:_ That, the property land Gut No. 52/2, totally admeasuring 11 H 41 R to the extent of B Hector was owned and possessed by M/s. Khorakiwara Hordings and Investment pvt. Ltd. Mumbai, and it sold the same to M/s. Future Ariances under the registered sare_deed dated 16'72'2006, M/s. Future Atiances sord the area to the extent 3 H 25 R to M/s. city Mangal construction of under the registered sale deed dated 24.r0.2010. However, one shamsundar Dwarkadas Somani fired a suit for specific performance of contract against M/s. Khorakiwara Hording and investment pvt. Ltd, and M/s. Future Alliances and its paftners and M/s. p.K. Deveropers bearing special civil suit No. 574/2008 in the court of theHon,bre civir Judge, senior Division, Aurangabad, thereby chailenging the sare deed executed by M/s. Khorakiwara Hordings and Investment pvt. Ltd. in favour M/s' Future Ariances and by Nl/s. of Future Alliances in favour of M/s. P'K. Deveropers,. However, the said suit ended with the compromise and as per the terms of compromise, M/s, Future Ariance agreed to allot and transfer the ownership and possessory right of protted area admeasuring 24600 sq. fts. in the layout ,, vyqr prepared by Lt vu l.ry them tglll. 1 @ Adn. Future Ailiances, to M/s. city Mangar construction, the responsibirity to hand over the protted area as per the consent terms of spr' c's' No. 574/2008 was praced upon M/s. city Mangal construction. But M/s, city Mangar construction and Mr. shamsundar Somani and Mr, pankaj Gangwar, setfled their dispute finaily and thereunder Mr, shamsunder somani and Mr. pankaj Gangwar relinquished ail their rights of whatsoever nature in the rand gut No, 52/2 of Village wadgaon Korhati, Tq. & Dist, Aurangabad in favour of M/s' city Mangar Construction, Accordingry, both of them executed registered Deed of consent on dated 27.L2.20L1, in favour of M/s. city Mangar construction, As such city Mangar constructions became owner and possessor of 0B Acres 33 Gunthe rand of Gut No.52/2(p) village Vadgaon Kolhati, Tal. & Dist. Aurangabad. It is seen that M/s. city Mangal construction, entered in to registered Deveropment agreement in respect of 1 H 76.25 R portion of land Gut no. 52/2 and specificaily bounded by East : Remaining portion of rand Gut No. 52/2, west: Remaining portion of rand gut no. 52/2, South : M.I.D.c. rand and North : 15 Meter wide Road, with Mr. Devanand Narayan Kotgire (HUF) on dated 15.10.2011, registered at Sr' No. 7799, at the office of the Sub Registrar, Aurangabad. In accor.ance with the terms and conditions of the said Deveropment Agreement, the partners of M/s. city Mangar construction arso executed the registered power of attorney in favour of Mr. Devanand Kotgire in respect of the said land. It is to be noted that at the time of purchase of rand by M/s. city Mangal Construction, the said firm consists of three partners namery, Mr' Nakul chandak, Mr. Abhishek Tapadia and Mr. Gopar soni. City Mangal Construction. It is seen that M/s. City Managal Constructions sold land to the extent of 01 H 76.25 R to M/s, Everest Reartors - a partnership firm under registered sale deed No.1272 dated 7s.02.20L3. The sale deed is registered at the office of sub-Registrar No. 5 at Aurangabad. The competent Revenue Authority has sanctioned the mutation in favour of M/s' Everest Reartors and its name is mutated in 7/L2 extract as owner and possessor of the land. It is seen that, on perusal of 7/L2 extract of land Gut No. 52/2, a charge of Cosmos Co-op. Bank Ltd. is recorded against the said property. That, on the basis of the above referred facts, I feer that, M/s. M/s' Everest Realtors - a partnership firm established clear chain of title for last more than 13 years in respect of above referred rand Gut No' No. 52/2, to the extent of 1 Hector 76.25 R. situated at wadgaon Kolhati, Tq' & Dist. Aurangabad and bounded as East : portion of land Gut No' 52/2, west : Remaining portion of land Gut No. s2/2, South : M.LD.C. Land and North : 15 mtr wide road. During my search as stated above, except the charge of cosmos co-op' Bank Ltd. Aurangabad, I did not trace out any encumbrances on the said properLy, as per the index record avairabre thereat. Therefore, In substance, I feer that, M/s. Everest Reartors, is having good marketable tiile on the property land Gut No.52/2,to the extent of 1 H 76.25 R situated at wadgaon Korhati, Tq.& Dist.
