    1       This is a Suo-Motu mafter taken up bv MahaRERA against the Respondenr,s ,siddhivinavak
            Apartment'. u'hich is registered ivith Nlaharera Registration No. p52800008061.



    2.      On revier,r.of the Respondent's project regishation, it is observed that the project
             registration of the said proiect has lapsed on September 30, 201g and thereafter, no
             extension oi dre date has been either sought or granted under the provisions of the Real
             Estate (Regulation and Development) Act, 2016 and rhe rules and regulatioru made
             thereunder. Further, the details available on the project registration r.r,€bpage sho\^, that the
             proiect is not vet completed. Moreover, the Respondent has not uploadetl the Arurual
             Audit Report o{ Statutory CA - Form 5 for Fy 17 l8 and Fy tg-19 till clate as required under
             the provisions of section 4(2) I and section 1t(1) of the Real Estate (Regulation and
             Development) AcL 2016 read with regulation .1 of the NlaiaRERA General Regulations,
             2017

         Since, there have been no online complainls iilcd lvith MahaRERA in this proiect, as ].et,
         this matter was taken up as a Suo N'lotu Conrplaint and the Respondent and Project
         Professionals, associated wift the project, were ceLlled Ior the hearing. No one appeared tor
         the Respofldent ard Project Professionals, associated widl the proiect in spite of s.rvicc of
         notice.


    4.   At this stage when the project registration period has lapsed, the only way forward would
         be to protect the dght of the allottees and enable them to {orm an Asso:iation oi allottees
         h'ho can take an irformed dedsion regarding carryirg out the balance \,\,ork to complete
         the prorect.



         In view of the abo\.e facts, the Respondent \,t/s H. N. Builders is herebv directed to
         hantlover the ]ist of al]ohees of the said proiect, along with their contact details, to all the
         allottees oI the said project, along la'ith a copv of this order, to enable the allottees to loml
         an association of allottees and thereafter take an informed decision pcrtaining to thc said
         project. ThereaJtet the association of allottees may like to pr(xeed under Section 7/8 of the
         Act as per the N,lahaRERA Order no. 8/2019 dated March 29. 2019.


         The Respondent is directed to upload the Anrual A dit Report of Statutor"- CA - Form 5 for
         FY 17-18 and FY 18-19 \^,ithin 15 days ftorn the date of dris Order.
